Acceptance of Terms
By using any AESIR product — including projectaesir.com, heimdall.projectaesir.com, or any AESIR-operated subdomain — you agree to these Terms. If you do not agree, do not use the products.
Your Account
You are responsible for keeping your credentials secure. You must be at least 13 years old to create an account. Users aged 13–17 may register only with the consent and involvement of a parent or legal guardian, who is bound by these Terms and must approve any SMS enrollment on the minor's behalf. You must provide accurate registration information. We may suspend or terminate accounts that violate these terms.
Acceptable Use
You agree not to:
- Use the products for unlawful purposes or in violation of any applicable law.
- Send spam, harvest emails for spam, or send communications in violation of CAN-SPAM, CASL, GDPR consent rules, or equivalent laws in your jurisdiction.
- Attempt to gain unauthorized access to the platform or other users' data.
- Reverse-engineer, scrape, or otherwise circumvent rate limits.
- Use the platform to harass, threaten, or harm others.
- Misrepresent the source of communications sent via the platform.
- Enter another person's mobile number for texting without first obtaining their consent.
HEIMDALL specifically: outbound emails are sent on your behalf using your connected mail credentials. You are responsible for ensuring your outreach complies with all applicable anti-spam and data-protection law.
Text Messages (SMS)
Limiting Factor uses SMS to deliver transactional messages (such as a login code you request) and, if you opt in, recurring training reminders. By providing your mobile number and opting in, you consent to receive automated text messages from Limiting Factor at that number. Consent is not a condition of purchase.
- Message frequency varies (e.g., up to one reminder per day if enabled, plus any login codes you request).
- Message & data rates may apply, per your mobile carrier plan.
- Reply STOP to any message to unsubscribe from recurring texts, HELP for help, or START to opt back in. Solo accounts can also turn texts off in account settings.
- If a coach or team lead adds you and sends an access code by text, they have confirmed to us that you agreed to receive it. Coaches and team leads must obtain your consent before entering your mobile number.
- If you are 13–17, a parent or legal guardian must consent to any recurring SMS enrollment on your behalf.
- Carriers are not liable for delayed or undelivered messages.
- We do not sell or share your mobile number or SMS consent with third parties for their own marketing.
OAuth Connections
When you connect a third-party account (TikTok, Instagram, YouTube, LinkedIn, X) via OAuth, you grant AESIR limited, read-only access to the public profile data those platforms permit under the scopes shown at the consent prompt. We never post, message, or take actions on your behalf without an explicit subsequent action you initiate. You may disconnect any OAuth integration at any time from the product's Settings page; doing so revokes our token and removes the cached profile.
Payment & Subscriptions
Paid AESIR products are billed per the plan you selected. Subscriptions auto-renew unless cancelled before the renewal date. Refunds are handled case-by-case at our discretion; contact us within 14 days of a charge to request a refund.
Intellectual Property
All AESIR-developed software, designs, content, and trademarks are the property of AESIR. You retain ownership of any data you upload or input. By using the products you grant us a limited license to host, process, and display your data solely to deliver the service.
DMCA & Takedown Requests
If you believe content on any AESIR property infringes your copyright, send a DMCA notice to [email protected] with the subject "DMCA Notice" and include all elements required under 17 U.S.C. § 512(c)(3).
Health, Fitness & AI Coaching
Limiting Factor is a fitness product, not a healthcare provider. It prescribes training loads and daily workouts, adjusts them to your readiness and training load, runs a PAR-Q health screen for individual accounts, and lets you report injuries and pain. None of it is medical advice or a replacement for a physician, an athletic trainer, or your unit's medical and human-performance (HPO) staff.
- You must be medically able to train. Answer any health screen honestly, and get a clinician's clearance first if anything limits your ability to exercise.
- Stop when your body says stop. Sharp or worsening pain, an injury, dizziness, chest pain or trouble breathing, or signs of heat illness mean stop training and seek care. No session is worth pushing through those.
- Your unit's medical guidance comes first. If you train with a military unit, duty-limiting profiles and instructions from your medical or HPO staff take precedence over anything this app prescribes.
- AI coaching can be wrong. AI sessions, chat replies and briefings are generated by a language model (Anthropic's Claude) and reach you without human review. Readiness and training-load adjustments that lower, cap or hold a load are aids to your judgment, not guarantees against injury. You decide whether to follow any of it.
- Crisis screening is a safety aid, not monitoring. Free text in coach chat, readiness check-ins and mid-workout adjustments is screened for signs of a medical emergency, self-harm or disordered eating. A flag shows you crisis resources and records an alert for review by your unit's welfare contact (Commander, First Sergeant or welfare POC) or, for individual accounts, by AESIR. No one staffs this around the clock, the screen can miss things, and we cannot guarantee anyone will see or respond. If you are in danger, call emergency services or, in the U.S., 988, not this app.
- Minors. No one under 13 may use Limiting Factor. If you are 13–17, you may use it only with a parent or legal guardian who accepts these Terms on your behalf and is responsible for supervising your training.
Assumption of risk. Physical training carries a real risk of injury, occasionally serious and rarely fatal, even when done correctly. By using Limiting Factor you accept that risk and agree that the choice to perform any prescribed workout, load or AI-suggested session is yours. The Warranty Disclaimer and Limitation of Liability apply to everything in this section.
Warranty Disclaimer
AESIR PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, AESIR DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, AESIR'S AGGREGATE LIABILITY ARISING FROM OR RELATING TO THESE TERMS OR THE PRODUCTS IS LIMITED TO THE AMOUNTS YOU PAID AESIR IN THE 12 MONTHS PRECEDING THE CLAIM. AESIR IS NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
Export Control
AESIR does not publish export-controlled technical data on this site. Technical data furnished under a separate agreement may be subject to U.S. export controls (the EAR or the ITAR) and will be marked and handled accordingly; you may not export, re-export or share such data except as that agreement and U.S. law allow. You represent you are not a denied party under U.S. export laws.
Termination
You may stop using the products at any time. We may suspend or terminate access for violation of these terms, non-payment, or to comply with legal requirements. Sections on Intellectual Property, Health, Fitness & AI Coaching, Warranty Disclaimer, Limitation of Liability, Export Control, and Governing Law survive termination.
Governing Law
These Terms are governed by the laws of the United States and the State of the principal AESIR office, without regard to conflict-of-law principles. Any dispute will be resolved in the state or federal courts located there.
